Good piece, thanks. I didn’t know the FTC was regulating social media influencers through Section 5 of the FTC act. My worry is that the FTC’s enforcement is toothless since they cannot enforce fines. Similarly, in the area of data privacy/protection, the size of the FTC’s civil penalties have been laughably small: multi-million-dollar corporations, such as the Taiwanese firm Asus, being fined $12,000 is ridiculous. Or Hershey’s $100,000.
